Petition Filed in Supreme Court in Connection to Killing of Man on Singhu Border, Appeal to Remove Farmers from the Protest Site

New Delhi, 16th Oct. A petition has been filed in the Supreme Court seeking urgent hearing on the pending PIL seeking removal of protesters at the borders of Delhi. This petition has been filed after the dead body of a man with one hand amputated was found at the farmers’ protest site on the Singhu border.
The body of Lakhbir Singh (35), a resident of Tarn Taran in Punjab, was found tied to a police barricade near a farmers’ protest site. He had 10 wounds from sharp weapons on his body and a group of Nihangs are being held responsible for the incident. Referring to the incident, a fresh petition has been filed seeking urgent hearing on the PIL pending since March this year.
The petition said, “Freedom of speech and expression cannot be above the right to life and if this protest is allowed to go on like this, the country will suffer massively.” Swati Goyal and Sanjeev Newar filed this interim application in their pending PIL through advocate Shashank Shekhar Jha.
The advocate said, “After the incident of murder and mutilation of a Dalit man, I have filed an application for urgent hearing before the Supreme Court. In the name of demonstrations, anti-humanitarian activities including rape of a woman and murder of a Dalit man and mutilation of dead bodies are taking place. It cannot be allowed to continue.
The PIL said, “The demonstration which is illegal in itself cannot be allowed to continue when anti-humanitarian acts are being seen in it.”
It said that many unforeseen and unacceptable incidents have been witnessed in the demonstrations including tractor rally on Republic Day, rape of a woman and killing of Lakhbir Singh on Dussehra.
It has been said in the petition that at a time when there is a ban on celebrating festivals, visiting temples, going to schools and colleges, then it would not be good to allow such demonstrations. It said, “The protesters are endangering not only themselves but the lives of millions of people of India and such a long movement cannot be allowed especially when the pandemic is prevailing.” Prolonged demonstration in public places is not only a clear violation of the orders of the Supreme Court but it is also violating the right to life of others who are directly or indirectly affected by these protests.
It has been said in the petition that the PIL was first listed for hearing on May 10, but due to a fault in one of the Supreme Court servers, the hearing could not take place on that day and even later it could not be heard.
